The downside of employers asking for Facebook passwords

Raganwald brings up an interesting point - If you, the employer, ask for someone's FB password, aren't you setting yourself up for a discrimination / harassment lawsuit?  To quote

My ability to select the best candidates for our positions has been irreparably compromised by looking into their private lives. I’ve been “tainted” by knowledge of their sexual orientation, illnesses, religion, political affiliations, and other factors that expose us to anti-discrimination legislation. We can't even claim that the employee improperly disclosed these matters to us, as we are the ones initiating the investigation of their private doings

Which is absolutely valid.  At worst, you open yourself up to a lawsuit.  At best, you end up being really careful around them, since now you "know stuff", and have to be absolutely sure to not give offense, step on any minefields, etc. etc. 
In short, you, the employer, are screwed if you go down this road.  Play safe.  Just Say No...
